WholesaleAI Terms of Service

These terms govern use of WholesaleAI, operated by Realtime Comms Ltd, a company incorporated in England and Wales. By installing or using the app, the Shopify merchant agrees to these terms.

1. Service

WholesaleAI provides software-assisted wholesale setup, buyer discovery, contact verification, drafting, application and CRM tools. Features may depend on Shopify and other service providers and may change as those services change.

2. Merchant responsibilities

Merchants remain responsible for reviewing generated content, approving outreach, keeping their products and wholesale terms accurate, choosing an appropriate lawful basis, providing required notices, and complying with marketing, privacy, consumer, tax and trade laws in each target jurisdiction. Merchants must honour opt-outs and must not use the service for unlawful, deceptive, abusive or indiscriminate messaging.

3. Data processing

Where Realtime Comms Ltd processes personal data on a merchant's behalf, the WholesaleAI Data Processing Addendum forms part of these terms. Our Privacy Policy explains our own processing and the service's retention practices. The merchant must not submit special-category or other highly sensitive data unless we have expressly agreed in writing.

4. Plans and availability

Shopify displays and administers applicable subscription charges. Sending limits, plan allowances and third-party availability may constrain use. We aim to provide a reliable service but do not promise uninterrupted or error-free operation.

5. Results and liability

Buyer, contact and email-verification results are not guaranteed. Automated suggestions require merchant review. To the extent permitted by law, WholesaleAI is provided without implied warranties and Realtime Comms Ltd is not liable for indirect or consequential loss. Nothing in these terms excludes liability that cannot lawfully be excluded.

6. Suspension and termination

We may suspend access needed to protect the service, comply with law or address a material breach. A merchant may terminate by uninstalling the app. Data is then handled under the Privacy Policy, the Data Processing Addendum and Shopify's mandatory deletion webhooks.
